General Terms and Conditions for arranging package holidays acc. Section 651V BGB

1. Scope of application

These general terms and conditions (GTC) apply to the contractual relationship between the travel the world, Marcel Franke eU, Handjerystraße 30, 12489 Berlin (hereinafter travel the world) and the customer.

Travel the world is mainly an intermediary for offers of travel events. Others only apply if this has been expressly pointed out.

General terms and conditions of the customer do not apply, even if Travel does not expressly object to these terms and conditions of the customer.

2. Conclusion of contract

2.1 Upon completion of the booking process, which can be issued verbally, in writing, by telephone or electronic means (e-mail / website), the customer offers Travel the world to conclude a mediation contract for travel services, which is concluded by the Travel world's declaration of acceptance. If the order is issued electronically, travel shall in principle only confirm the world by receipt of the order by electronic means. A confirmation of receipt does not constitute an acceptance of the mediation mandate.

2.2 The mutual rights and obligations of the customer and the travel agent, insofar as there are no mandatory statutory provisions, arise from the agreements concluded in individual cases, these terms and conditions and the statutory provisions, in particular Sections 65la ff BGB in conjunction with the Convention. Art. 250ff. EGBGB and sections 675, 631 ff. BGB about the paid business provision.

2.3 The rights and obligations of the customer towards travel the world are exclusively the agreements made with them, in particular - to the extent effectively agreed - their travel or business conditions. Without a special agreement or without special notice, the conditions of carriage and tariffs adopted by the competent transport authority or international agreements on the basis of transport services shall apply.

3. Payments and notifications

3.1 Travel the world and tour operators may only demand or accept payments on the tour price before the end of the package if the tour operator has an effective customer money protection contract and the customer has been handed over to the customer's security certificate with the name and contact details of the customer money securitist in a clear, understandable and highlighted manner.

3.2 Travel the world is considered to be authorised by the tour operator to accept notices of defects and other declarations by the customer/traveller regarding the provision of the package. Travel the world will immediately inform the tour operator of such declarations by the traveller. 4. Information and information

4.3 Travel the world is only obliged to determine and/or offer the most favourable provider of the requested travel service if an express agreement is provided.

4.4 Without an express agreement, Travel shall not assume any guarantee within the meaning of section 276 para. 1 sentence 1 BGB and information about the availability of the services to be mediated, do not guarantee procurement within the meaning of this provision.

4.5 Travel the world accepts special requests from the customer and forwards it to the tour operator. The world shall only be responsible for the fulfilment of such special requests, insofar as this is expressly agreed. The fulfilment of special requests is not a condition or a contractual basis for the mediation order or for the booking declaration of the customer to be transmitted by the travel agency to the package tour operator, unless this has been expressly agreed. The customer is informed that special requests are usually only to the content of the contractual obligations of the package tour operator by express confirmation of the package tour operator.

5. payments via travel the world

5.1 Travel the world is entitled to demand payments in accordance with the performance and payment provisions of the brokered service providers, insofar as these are effectively agreed between the service provider and the customer and contain legally effective payment provisions.

Insofar as this corresponds to the agreements between the world the world and the service provider, travel may assert claims for payment against the customer as its collection representative, but also on the basis of the customer's statutory advance obligation as a customer pursuant to Section 669 of the German Civil Code.

5.2 The above provisions apply accordingly to cancellation costs (compensation for cancellation) and other legally or contractual claims of the mediated service provider.

5.3 If the travel performance of performance disruptions or changes such as travel the world mediated by Travel Rebooking, withdrawal or termination affected by the customer or the organiser, this does not affect the claim of travel the world to pay for a charged service fee for consulting, mediation and other services already provided.

5.4 The customer may not confront the world of his own payment claims by way of retention or offsetting that the customer has claims against the mediated service provider, in particular due to the defective performance of the mediated contract. This does not apply if a culpable breach of contractual obligations by the agent has become causal or co-industrial reasons for the occurrence of such claims, or if travel is liable to the customer for the asserted counterclaims for other reasons.

5.5 Travel The world reserves the right to charge a payment fee of 3.5% of the total invoice amount to the customer for payments via Paypal (including by credit card).

6. Placement of flight transport services

6.1 In accordance with EU Regulation No 2111/2005, on the preparation of a Community list of airlines, Travel is obliged to inform the passenger about the identity of the operating airline at the time of booking. If the operating airline is not yet determined at the time of booking, Travel will send the world the information available by the company about the airline that is likely to operate the flight. In the event of a change of change, the customer will be informed of the bill of exchange immediately. The Community list of airlines banned by flight in the European Union is available on the website http://ec.europa.eu/transport/modes/air/safety/air-ban/index-en.htm and www.lba.de.

6.2 The contractual relationship between the customer and the airline applies - as far as applicable the legal provisions of the German Aviation Act, the Warsaw and the Montreal Convention and directly, as well as domestic statutory provisions, Regulation (EC) No 261/2004 on air passenger rights, Regulation (EC) No 2111/2005 on the preparation of a Community list of air carriers against which is a lower office of the Community.

6.3 The customer is strongly recommended to inform themselves about their rights as passengers, e.g. by the notices in the airports, by the information provided by the operating air carrier or by the information sheets of the Federal Aviation Office at www.lba.de.

7. Examination of travel documents

7.1 Both the customer and travel the world are obliged to check the contract and other documents of the arranged package tour operator via the package tour handed over to the customer through travel, in particular booking confirmations, tickets, hotel vouchers, visas, insurance certificates and other documents about the arranged package tour, in particular for compliance with the booking and the brokered order.

7.2 Insofar as documents on the arranged package tour are not transmitted to the customer directly from the brokered package tour operator, the handover by travel the world is made by post or electronic shipping.

8. Participation of the customer

8.1 The customer must notify the world immediately of any identifiable defects or defects in the mediation activities of Travel after they have been discovered. This includes in particular incorrect or incomplete information about personal customer data, other information, information and documents about the arranged package tour as well as the not complete execution of mediation services (e.g. non-bookings or reservations).

8.2 Does not be displayed according to No. 8.1 by the customer, the following applies:

a) Does not include the customer's advertisement in accordance with Clause. 8.1 His claims shall not be waived.

b) Claims of the customer for travel the world shall be omitted insofar as the latter proves that the customer would not have suffered damage if the customer had subjected to proper notification or not in the amount asserted by the customer. This applies in particular to the extent that Travel would have enabled an immediate notification by the customer Travel the world the opportunity to remedy the defect or reduce damage, e.g. by rebooking, additional booking or cancellation with the brokered package tour organiser, would have enabled

c) Claims of the customer in the event of a default notification according to No. 8.1 are not omitted in the event of damage resulting from injury to life, body or health resulting from an intentional or negligent breach of duty by travel, the world or a legal representative or vicarious agent; claims for compensation for other damages based on an intentional or grossly negligent breach of duty by travel the world or a legal representative or vicarious agent; in the event of a breach of an essential obligation, the fulfilment of which makes the proper execution of the mediation contract possible in the first place or the violation of which jeopardises the achievement of the purpose of the contract.

8.3 Liability for booking errors pursuant to Section 651x BGB remains unaffected.

9. Withdrawal

9.1 The customer is entitled to withdraw from the journey at any time before the start of the trip, in accordance with the statutory provisions of Section 651 h of the German Civil Code (BGB). Any advance payments paid by the customer must be repaid by Travel the world. Travel the world may demand appropriate compensation from the customer in such a case pursuant to Section 651h para. 2 BGB. The cancellation fees incurred are as set forth:

20% for cancellation up to 30 days before the start of the trip

30% if cancelled from the 29th to the 22nd to the last Day before departure

35% for withdrawal from 21 to 15th. Day before departure

45% for withdrawal from 14 to 7. Day before departure

55% for withdrawal from 6. Day before departure

75% if not occurring.

The customer is free to prove that there has been a lower than the damage claimed in the lump sum.

9.2 If the start of the trip is impossible for the customer due to force majeure, the cancellation fees specified in 9.1 shall not apply. Force majeure is regarded as events such as natural disasters, epidemics, wars and political unrest.

9.3 The provisions of 9.1 and 9.2 apply to the customer to Travel Die Welt only and exclusively in the event that Travel Die Welt itself is the organiser of the trip. Otherwise, the provisions of the respective organiser plus any applicable fees apply to arranged services.

9.4 Services provided by Travel die Welt itself, which have already been charged, are non-refundable in accordance with clause 5.3. The right to payment of the service fee thus remains in force if there is also the cancellation.

10. Obligations of Travel the world for complaints towards the brokered package tour operators.

The customer may bring to the attention of defects in notes and other declarations regarding the provision of the travel services by the package tour operator and travel the world.

However, there is no obligation for travel the world to advise the customers with regard to the type, scope, amount, conditions of claims and other legal provisions to be met, concerning the claims against the brokered package tour operators.

11. Important information on insurance of package holidays

11.1 Travel the world indicates the possibility of taking out travel cancellation insurance when booking to minimise cost risk incurred in cancellations by the customer.

11.2 The customer is further informed that travel cancellation cost insurance usually does not cover the resulting damage, which may incur him incurred by terminating the package after their commencement of the package trip, even without notice. Travel agency insurance is usually to be taken out separately.

11.3 Travel around the world also recommends that you pay attention to sufficient health insurance for international health insurance when travelling abroad.

11.4 When brokering travel insurance companies, the customer is advised that the insurance conditions of the mediated travel insurance may include special contractual terms and/or obligations of cooperation of the customer, in particular exclusions of liability (e.g. in the case of pre-existing conditions), the obligation to cancel in travel cancellation insurance, deadlines for damage notice and deposits. Travel the world is not liable insofar as he has not made false information regarding the insurance conditions and the brokered travel insurer has a right of refusal of benefits to the customer due to effectively agreed insurance conditions.

12. Liability

12.1 Travel the world is not liable for the conclusion of contracts with the package tour operators to be mediated, unless he has expressly agreed on a corresponding contractual obligation.

12.2 Travel the world is not liable for defects and damages incurred by the customer in connection with the travel service. This does not apply to an express agreement or assurance of the travel agent, in particular if this differs considerably from the service description of the package tour operator.

12.3 Any own liability of the travel agent in section 651x BGB or the culpable violation of travel agency obligations shall remain unaffected by the above provisions.

13. Change of program items of travel

13.1 We at Travel The world are committed to providing our valued customers with unforgettable travel experiences. Please note that we act as an intermediary for offers from tour operators. As a result, programme items from our group trips can occasionally be changed by the tour operator due to customer feedback or for other reasons to optimise the travel experience.

13.2 The feedback from customers is of great importance for the continuous improvement of travel offers. If the tour operator decides to adjust or change certain items to the programme, this is his responsibility as an organiser of the trip.

13.3 We as Travel Die Welt will do our best to inform you of planned changes to items before booking, provided that the tour operator informs us accordingly. However, changes may only be made after booking or during travel planning. In such cases, we will endeavour to inform you of the changes as soon as possible, but this cannot be guaranteed.

13.4 Please note that changes to items of the program are not a reason for cancellation or refund of the booked travel or partial services. As an intermediary, we have no control over the tour operator's decisions regarding the programming. Customers who have already booked a trip with us can be informed about the changes upon request, but are not entitled to a cancellation or refund for this reason.

14. Reservation of change

14.1 Travel the world is entitled to change the GTC if this is necessary for good reason and the original ratio of performance and consideration is maintained by the change, so that the change is reasonable for the customer. A valid reason exists if and insofar as developments after the conclusion of the contract, travel could not foresee the world and which travel were neither brought about nor influenced by travel, there are no insignificant difficulties in the implementation of the contract. A valid reason remains if and insofar as this is necessary for the elimination of not insignificant difficulties in the execution of the contract due to loopholes in the establishment of regulations which arose after the conclusion of the contract. A regulatory gap may arise in particular if the case law changes to the effectiveness of these GTC or if a change in the law leads to the invalidity of one or more provisions of these GTC.

14.2 Travel the world is entitled to change the agreed services if and to the extent necessary for good reason and the original ratio of performance and consideration is maintained, so that the change is reasonable for the customer. A valid reason exists in particular if the change is necessary to adapt to technical innovations or due to legal or official requirements.

14.3 Changes acc. Sections 14.1 and/or 14.2 will be notified to the customer for a minimum of 6 weeks, at most 2 months before the change is to become effective. In this notice, the customer is informed clearly and comprehensibly about the time and content of the change

15. Consumer dispute resolution

Travel the world points out with regard to the Consumer Controversy Resolution Act that Travel does not participate in a dispute settlement procedure before a consumer arbitration board.

If a consumer dispute resolution would become mandatory after printing these terms and conditions about the placement of package holidays for the presentation of the travel agent, Travel informs the world in an appropriate form.

Travel the world refers to the European online dispute resolution platform for all package holidays contracts concluded in electronic legal transactions. http://ec.europa.eu/consumers/odr.

16. Information on data protection

Information on the type, scope, location and purpose of the collection and use of personal data of the customer, on fundamental processing amounts as well as about its design, election and other rights of data subject are provided in our privacy policy.
